Rental Deposits in Mexico: Depósito, Aval and Fianza Explained
Renting in Mexico? Learn what depósito, aval, fianza and póliza jurídica mean, what landlords usually ask for, and the Spanish to ask about getting your deposit back.

When you rent a place in Mexico, the monthly rent is only part of the conversation. Before you get the keys, you'll hear words like depósito, aval, fianza and póliza jurídica. They decide how much money you pay upfront and how easy it is to get some of it back.
This guide explains what each term means and gives you the Spanish to ask the right questions.
The key terms
| Spanish | English | What it usually means |
|---|---|---|
| depósito (en garantía) | security deposit | Money you pay at the start and get back at the end, minus damages or unpaid bills |
| renta adelantada | rent in advance | The first month (or more) paid before you move in |
| aval / fiador | guarantor | A person who agrees to pay if you don't; often must own property in the same city |
| fianza | surety bond | A guarantee issued by a bonding company (afianzadora) |
| póliza jurídica | legal rental policy | A paid service that checks the tenant and backs the landlord legally |
| contrato de arrendamiento | lease agreement | The rental contract |
| arrendador / arrendatario | landlord / tenant | The two sides of the contract |
| inventario | inventory | A list of furniture and items in the apartment and their condition |
The word fianza causes confusion. In Spain it often means the deposit itself. In Mexico it usually refers to a bond from a company, so if a listing mentions it, ask what they mean.
The depósito
For a long-term rental, a deposit of one month's rent is common, and some landlords ask for two, especially for furnished places. You'll usually pay it together with the first month of rent.
Typical conditions you'll see in a contract:
- The deposit is returned at the end of the lease, after checking the apartment.
- Damages beyond normal use and unpaid bills (electricity, gas, water, maintenance) are taken from it.
- The deposit can't be used as the last month's rent. This clause is very common. Ask before you assume otherwise.
The aval: the requirement that surprises foreigners
Many Mexican landlords ask for an aval: someone who guarantees your rent. Often the aval must own a property in the same city, free of mortgage or legal problems (libre de gravamen). Most newcomers don't know anyone who can do that.
Common alternatives, depending on the landlord:
- Póliza jurídica. A company reviews your documents and income, and you (or the landlord) pay a fee for it.
- A larger deposit. Two or more months instead of an aval.
- Paying several months upfront. Some landlords accept this instead of a guarantor.
- Furnished or short-term rentals. These often skip the aval but cost more per month.
Always ask: "¿Qué opciones hay si no tengo aval?" (What are the options if I don't have a guarantor?)
Questions to ask about the deposit
| Spanish | English |
|---|---|
| ¿De cuánto es el depósito? | How much is the deposit? |
| ¿Cuántos meses de depósito piden? | How many months of deposit do you ask for? |
| ¿Piden aval o aceptan póliza jurídica? | Do you require a guarantor or do you accept a legal policy? |
| ¿Puedo dejar más depósito en lugar de aval? | Can I leave a larger deposit instead of a guarantor? |
| ¿Cuándo me devuelven el depósito? | When do I get the deposit back? |
| ¿Qué se descuenta del depósito? | What is deducted from the deposit? |
| ¿Hacemos el inventario juntos? | Shall we do the inventory together? |
| ¿Me da un recibo del depósito? | Can you give me a receipt for the deposit? |

Dialogue: no aval
You: Me interesa el departamento. ¿Qué piden para rentarlo? (I'm interested in the apartment. What do you require to rent it?)
Landlord: Un mes de depósito, el primer mes adelantado y un aval con propiedad aquí en la ciudad. (One month's deposit, the first month in advance and a guarantor with property here in the city.)
You: No tengo aval. ¿Aceptan póliza jurídica? (I don't have a guarantor. Do you accept a legal policy?)
Landlord: Sí, pero el costo de la póliza lo paga usted. (Yes, but you pay for the policy.)
You: Está bien. ¿Y el depósito cuándo me lo devuelven? (That's fine. And when do I get the deposit back?)
Landlord: Al terminar el contrato, después de revisar el departamento. (When the contract ends, after checking the apartment.)
Vacation rentals and villas
Short stays work differently. With a vacation rental or villa, you may see:
| Spanish | English | What to check |
|---|---|---|
| depósito de seguridad / depósito reembolsable | security / refundable deposit | How much, and how many days after check-out it's refunded |
| cargo por limpieza | cleaning fee | Usually not refundable |
| retención en tarjeta | hold on your card | The amount blocked, not charged, and when it's released |
| política de cancelación | cancellation policy | What you lose if you cancel |
A useful question before booking: "¿En cuántos días se devuelve el depósito después de la salida?" (How many days after check-out is the deposit returned?) If you book through a platform, follow its rules and keep all messages there. For phrases during your stay, see Spanish phrases for your Airbnb in Mexico.
How to protect your deposit
- Do the inventory together on move-in day, and take photos and videos of every room.
- Write the deposit amount and return conditions in the contract.
- Pay by bank transfer or ask for a signed receipt, so there's a record.
- Keep your last bills paid and save the receipts before you move out.
- Ask for a final walkthrough: "¿Podemos revisar el departamento juntos antes de entregar las llaves?" (Can we check the apartment together before I hand over the keys?)
Before you sign, it also helps to know how to read rental listings in Mexico, so you understand what's included from the start.
